Nonconsensual Towing

House Bill 1743 (2011) goes into effect November 1, 2011. The bill transfers certain aspects of nonconsensual towing regulation to the Oklahoma Corporation Commission from the Department of Public Safety. The main things the Commission will now handle are:

  • Establishing, supervising, and enforcing rates
  • Mediating and adjudicating complaints.

Assessment

A letter advising of the annual assessment amount that must be paid by each wrecker operator performing non-consensual tows has been mailed. The assessment and a copy of the invoice must be remitted to the OCC by December 15, 2011.  The assessment is $74.29 per applicable vehicle. Notice of Hearing to Establish Billing Procedures for Indoor Storage and After-hours Release of Nonconsensual Tows

Because DPS amended their rules and removed the provisions that described how and when to apply indoor storage and after-hours release rates, it was necessary for the OCC to establish those same provisions ensuring both the wrecker industry and the public interests are protected. On January 13, 2012, the Commission established rules concerning fees charged for indoor storage and after-hours release.
